While I like what you attempted here, and the foreground is really nice (especially the wine (?) glass), I think the background spoils it all. Especially with the blur on the face of the man and the weird thing on the shirt (I couldn't determine what it was).

This is a little busy, but I don't guess you could control all the elements very well. It really is a good moment frozen in time of a quiet bar for a night cap.

this appears as if it's inside a restaurant? not saying it isn't night, but this is more about the lighting and the reflection of that glass to me, than saying 'night.'
